These Terms and Conditions (“Terms”) govern your access to and use of the DroneLeak.ca website and the drone-based leak detection, thermal imaging, and building inspection services (“Services”) provided by DroneLeak.ca, a subdivision of AnyLeak.ca, located at 1985 Queens Avenue, West Vancouver, British Columbia V7V 2X8, Canada (“Company”, “we”, “us”, or “our”). By accessing our website or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use our website or Services.

1. Services Provided

DroneLeak.ca provides professional drone-based inspection and leak detection services across British Columbia, including but not limited to:

  • Aerial Moisture Intrusion Detection
  • Building Envelope Leak Diagnostics
  • Thermal Drone Inspections
  • Flat Roof Leak Detection
  • Multi-Unit Property Aerial Scans
  • Government Building Drone Audits
  • High-Rise Visual Analytics
  • Post-Rain and Storm Leak Detection

All Services are subject to site accessibility, weather conditions, airspace regulations, and Transport Canada drone operating requirements. We reserve the right to reschedule or decline any engagement where safety or regulatory constraints cannot be met.

2. Use of Our Website

You agree to use the DroneLeak.ca website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Attempt to gain unauthorized access to any part of our website or systems.
  • Use our website to transmit malicious code, spam, or harmful content.
  • Scrape, copy, or reproduce our content without written permission.
  • Use our website in a way that imposes an unreasonable load on our infrastructure.
  • Misrepresent your identity or affiliation when contacting us.

3. Quotes and Service Agreements

Any quotes or estimates provided by DroneLeak.ca via phone or email are non-binding until confirmed in a written service agreement signed by both parties. Final pricing is subject to:

  • Site conditions and accessibility assessment.
  • Scope of inspection agreed upon prior to mobilization.
  • Applicable taxes and fees.
  • Airspace authorization requirements or special permits.

Changes to scope of work following commencement of services may result in additional charges, which will be communicated and agreed to in writing prior to proceeding.

4. Client Responsibilities

By engaging our Services, you agree to:

  • Provide accurate and complete information about the property and the nature of the concern.
  • Ensure lawful authorization to permit drone operations over the property, including consent of affected property owners or strata corporations.
  • Notify occupants and adjacent property owners as required by applicable regulations or bylaws.
  • Ensure safe access to the site for our personnel and equipment.
  • Review and act on inspection reports within a reasonable timeframe.

5. Intellectual Property

All content on the DroneLeak.ca website, including text, graphics, logos, icons, images, and software, is the property of DroneLeak.ca or its content suppliers and is protected by Canadian copyright and intellectual property laws. Inspection reports, thermal images, and analytical data generated for a specific client engagement are provided for that client's use only and may not be reproduced, distributed, or published without our prior written consent. We retain ownership of all underlying methodologies, proprietary processes, and analytical frameworks.

6. Disclaimer of Warranties

Our website and Services are provided on an “as is” and “as available” basis. While we apply professional expertise and industry-standard equipment to all engagements, drone-based thermal and visual inspection is a non-invasive, non-destructive assessment method. Results are subject to environmental conditions including ambient temperature, weather, surface moisture, and building occupancy at the time of inspection. DroneLeak.ca does not warrant that inspections will detect every defect or moisture source within a structure. Findings should be corroborated by a licensed engineer or contractor where building remediation is contemplated.

7. Limitation of Liability

To the maximum extent permitted by applicable law, DroneLeak.ca and its parent organization AnyLeak.ca shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or Services, including but not limited to loss of profits, data, or property. Our total aggregate liability for any claim arising out of or related to a specific service engagement shall not exceed the fees paid by you for that engagement. Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence.

8. Drone Operations and Regulatory Compliance

All drone operations conducted by DroneLeak.ca are performed by Transport Canada certified Remote Pilot Certificate holders in compliance with the Aeronautics Act and Canadian Aviation Regulations (CARs), Part IX. We obtain all required airspace authorizations and operate within designated flight zones. Clients must not interfere with active flight operations and must inform us immediately of any known airspace restrictions, temporary flight restrictions, or site hazards that may affect safe drone deployment.

9. Cancellation and Rescheduling

We require a minimum of 48 hours' notice to cancel or reschedule a confirmed inspection without incurring a cancellation fee. Cancellations with less than 48 hours' notice may be subject to a fee equivalent to 25% of the quoted service value to cover mobilization and preparation costs. Cancellations due to unsafe weather conditions or airspace restrictions identified by our operators on the day of service will not incur a cancellation fee, and we will work with you to reschedule at the earliest available opportunity.

10. Privacy

Your use of our website and Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our collection and use of your personal information as described in that policy.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of British Columbia.

12. Amendments

We reserve the right to amend these Terms at any time by posting the revised version on this page with an updated “Last updated” date. Your continued use of our website or Services following such changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
